THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. BRANDON GRANT, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Onondaga County Court, rendered October 19, 2015,

Now, upon reading and filing the affidavit of Kenneth Moynihan, Esq. sworn to August 24, 2016, the notices of motion with proof of service thereof, the affidavit of Brandin Grant sworn to August 30, 2016, and due deliberation having been had thereon,

It is hereby ORDERED that the motions are granted to the extent that the notice of appeal dated November 19, 2015 which was filed at the Onondaga County Clerk's Office and served upon the Onondaga District Attorney's Office on November 19, 2015 is hereby deemed timely filed and served.
