People v. Gonzalez

Appellate Division of the Supreme Court of New York, Second Department
Apr 21, 1986
119 A.D.2d 768 (N.Y. App. Div. 1986)

Opinion

April 21, 1986

Appeal from the Supreme Court, Kings County (Goldstein, J.).

Judgment affirmed.

The evidence adduced at trial was sufficient to permit a rational trier of fact to find that the defendant was guilty beyond a reasonable doubt of manslaughter in the second degree (see, Penal Law § 125.15; People v. Contes, 60 N.Y.2d 620, 621). Moreover, the People disproved the defendant's justification defense beyond a reasonable doubt (see, Penal Law § 25.00; §§ 35.00, 35.15). Mollen, P.J., Mangano, Gibbons and Bracken, JJ., concur.
