People v. Fazio

Court of Appeals of the State of New York
Apr 30, 1964
199 N.E.2d 162 (N.Y. 1964)

Opinion

Argued March 30, 1964

Decided April 30, 1964

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, SAMUEL S. LEIBOWITZ, J.

Thomas R. Beecher, Jr., for appellant.

Edward S. Silver, District Attorney ( William I. Siegel of counsel), for respondent.

Order affirmed upon the ground that, unlike People v. Mangi ( 10 N.Y.2d 86), it was not the District Attorney who prevented the accomplice witness from fully explaining his motive for offering testimony that implicated defendant in the crime for which he was convicted.

Concur: Chief Judge DESMOND and Judges DYE, FULD, VAN VOORHIS, BURKE, SCILEPPI and BERGAN.
