Application by the appellant for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated December 22, 2003 ( People v Dolan, 2 AD3d 745), affirming a judgment of the County Court, Suffolk County, rendered April 20, 1995.

Before: Florio, J.P., Miller, Krausman and Rivera, JJ., concur.


Ordered that the application is denied.

The appellant has failed to establish that he was denied the effective assistance of appellate counsel ( see Jones v Barnes, 463 US 745; People v Stultz, 2 NY3d 277 [2004]).
