People v. Diaz

Appellate Division of the Supreme Court of New York, Third Department
Jan 18, 1990
157 A.D.2d 923 (N.Y. App. Div. 1990)

Opinion

January 18, 1990

Appeal from the County Court of Clinton County (Lewis, J.).

Defendant voluntarily waived his right to appeal as part of his negotiated plea. The record reveals no basis for finding this waiver invalid and, accordingly, defendant's appeal should be dismissed (see, People v. Seaberg, 74 N.Y.2d 1).

Appeal dismissed. Mahoney, P.J., Kane, Casey, Levine and Harvey, JJ., concur.
