THE COURT:

It is ordered that the opinion filed herein on August 10, 2010, be modified as follows: on page 34, first full paragraph, line 1, delete the text: “Mr. Jackson and Ms. Cox argue” and insert the text “Mr. Jackson, Mr. Jones, and Ms. Cox argue”.

On page 48, line 2, following the citation to People v. Anderson (1968) 70 Cal.2d 15, 27.) insert the text “Moreover, despite his argument to the contrary, there was substantial evidence to support Mr. Jones’s second degree murder conviction based upon the aforementioned evidence.”
