People v. Callens

Appellate Division of the Supreme Court of New York, Fourth Department
Dec 29, 1993
199 A.D.2d 992 (N.Y. App. Div. 1993)

Opinion

December 29, 1993

Appeal from the Erie County Court, D'Amico, J.

Present — Pine, J.P., Balio, Doerr and Boehm, JJ.

Judgment unanimously affirmed. Memorandum: We conclude that defendant's plea of guilty was entered knowingly, voluntarily, and intelligently. Because defendant's plea included the waiver of his right to appeal, defendant has waived any right to have this Court consider the excessiveness of his sentence (see, People v Allen, 82 N.Y.2d 761).
