Appeal from the Supreme Court, Queens County (O'Brien, J., Flaherty, J.).


Ordered that the judgment and order are affirmed.

The testimony at the hearing established that the defendant was present at the Sandoval hearing. Accordingly, the defendant was not denied his right to be present at all material stages of the trial (see, People v Dokes, 79 N.Y.2d 656).

We have examined the defendant's remaining contentions and find them to be either without merit or unpreserved for appellate review. Mangano, P.J., Bracken, Altman and Goldstein, JJ., concur.
