MEMORANDUM OPINION

Before Chief Justice Wright, Justice Lang-Miers, and Justice Stoddart
Opinion by Chief Justice Wright

Appellant has failed to comply with our January 29, 2016 order that he provide written verification, no later than February 10, 2016, that he has paid, or made arrangements to pay, for the clerk's record, or is entitled to proceed in the appeal without prepayment of costs. Our January 29th order cautioned appellant that failure to comply could result in the appeal being dismissed without further notice. See TEX. R. APP. P. 37.3(b). Because he has failed to comply, we dismiss the appeal. See id., 42.3(b),(c).
