We REINSTATE this appeal.
On June 2, 2023, we struck volume 2 of the clerk's record and abated this appeal for the trial court to determine whether the documents in volume 2 of the clerk's record should be subject to a sealing order and, if so, "to sign a sealing order sealing those documents the trial court found should be subject to a sealing order." (emphasis added). On August 24, 2023, the district clerk refiled volume 2 with an unsigned sealing order as the first document in the sealed clerk's record. Accordingly, we STRIKE volume 2 of the clerk's record filed August 24, 2023. We ORDER the Honorable Lela Mays, Presiding Judge, 283rd Judicial District Court, if she has not already done so, to sign the sealing order for volume 2 of the clerk's record and transmit the order to the district clerk, and we ORDER Felicia Pitre, Dallas County District Clerk, to refile volume 2 of the clerk's record within FIFTEEN DAYS of the date of this order with the signed sealing order as the first document in volume 2 of the clerk's record.
We DIRECT the Clerk of the Court to send copies of this order to the Honorable Lela Mays, Presiding Judge, 283rd Judicial District Court; Felicia Pitre, Dallas County District Clerk; and counsel for all parties.
This appeal is ABATED for the trial court to comply with the above order. The appeal will be reinstated when volume 2 of the clerk's record is refiled or at such other time as the Court deems proper.
