This case for the redetermination of a deficiency, presently set for trial during the Dallas, Texas, trial session scheduled to begin on October 30, 2023, is before the Court on respondent's motion to dismiss for lack of jurisdiction, filed August 18, 2023. Giving due regard to the representations contained in that motion, it is

ORDERED that respondent's motion is set for hearing at the place shown in the Notice Setting Case for Trial, served June 13, 2023, at a time and date certain of 2:00 p.m. on Tuesday, October 31, 2023. It is further

ORDERED that the parties are excused from appearing on October 30, 2023, as previously directed. The parties should be prepared to proceed to trial if respondent's motion is not dispositive.
