Oduok v. Bowden

Supreme Court of Georgia
Sep 11, 2000
272 Ga. 778 (Ga. 2000)

Opinion

S00A0670.

DECIDED: SEPTEMBER 11, 2000.

Appeal from DeKalb County Superior Court, Trial Judge: Hon. Edward D. Wheeler, Date of Judgment Appealed: 10-26-99, Notice of Appeal Date: 11-22-99, Lower Ct#:99CV63499.

Attorneys:

PRO S.E. Appellant: Inyang Peter Oduok, P.O. Box 675764, Marietta, GA 300060021

Attorneys for Appellee:

Howard Walter Indermark, Asst. Cty. Atty, DeKalb County Law Department, 1300 Commerce Drive, Fifth Floor, Decatur, GA 30030, Jonathan A. Weintraub, County Attorney, DeKalb County Law Department. Joan F. Roach, Chief Asst. Cty. Atty.

Mandamus. DeKalb Superior Court. Before Judge Wheeler, Senior Judge.

Inyang P. Oduok, pro se.

Jonathan A. Weintraub, Joan R. Roach, Howard W. Indermark, for appellees.

The appellant, Inyang Peter Oduok, appeals from an adverse ruling on his petition for a writ of mandamus and prohibition. In that petition, Oduok raised numerous issues concerning his pending criminal prosecution, and sought, among other things, the dismissal of the prosecution. Because Oduok has an adequate remedy at law — his pending criminal trial and any appeal therefrom if he is convicted — in which to raise the issues he raised in his petition for writ of mandamus and prohibition, the trial court properly denied that petition. Accordingly, we affirm the trial court's decision.

See Jersawitz v. Riley, 269 Ga. 546, 547 ( 500 S.E.2d 579) (1998); Holmes v. Board of Commissioners, 271 Ga. 206 ( 517 S.E.2d 788) (1999).

Judgment affirmed. All the Justices concur, except Hines, J., not participating.

DECIDED SEPTEMBER 11, 2000 — RECONSIDERATION DENIED SEPTEMBER 29, 2000.
