INJUNCTION
Plaintiff Aror Ark O'Diah brought, inter alia, claims against defendant Tsunis Gasparis ("Tsunis"), a Long Island law firm, for violations of the Civil Rights Act of 1964 and the Fair Credit Reporting Act. In the Court's Opinion and Order of August 21, 2002, pursuant to Tsunis' motion, both of these claims were dismissed with prejudice.
At the same time that Tsunis moved to dismiss plaintiff's claims, it requested that a filing injunction be entered against plaintiff with respect to Tsunis. The Court did not grant this injunction in its August 21 Opinion and Order. By letter of September 12, 2002, Tsunis seeks clarification as to whether a filing injunction will issue.
Having determined that the issuance of a filing injunction is appropriate for the reasons described in this Court's Opinion and Order of August 21, 2002, and the plaintiff having been given notice and an opportunity to be heard regarding the issuance of a filing injunction with respect to Tsunis, it is hereby ORDERED that the plaintiff is barred from commencing any future action against Tusnis relating to the transactions or occurrences alleged in the complaint filed in this action, including claims relating to his 2000 eviction, and any claims relating to alleged misrepresentations made about the plaintiff to other entities or to credit reporting agencies, without leave of the court in which the action is to be filed.
IT IS FURTHER ORDERED that the plaintiff shall attach a copy of this Injunction and the Court's August 21, 2002 Opinion and Order to any pleading filed, or attempted to be filed in any court, in which Tsunis is named as a defendant.
