ORDER MODIFYING OPINION, DENYING PETITION FOR REHEARING, AND DISMISSING MOTION

THE COURT:

It is ordered that the typewritten opinion filed on April 22, 2005 (128 Cal.App.4th 831; ___Cal.Rptr.3d___), be modified as follows:

On page 49 [128 Cal.App.4th 866, advance report], under the heading “DISPOSITION”, following the second sentence of the paragraph, insert the following sentence:

The trial court is further directed to issue a preliminary injunction staying enforcement of Part XXV. (See Barajas v. City of Anaheim, supra, 15 Cal.App.4th at pp. 1813, 1820.)

With the above modification, the petition for rehearing is denied. In light of the modification of the opinion herein, appellant’s motion for appellate injunction is dismissed as moot.

This modification constitutes a change in the judgment. (California Rules of Court, rule 24(c)(2).)
