Nutter v. State

District Court of Appeal of Florida, First District
Nov 10, 1999
745 So. 2d 446 (Fla. Dist. Ct. App. 1999)

Opinion

No. 99-1914.

Opinion filed November 10, 1999.

An appeal from an order of the Circuit Court for Gulf County, Glenn L. Hess, Judge.

Michael Nutter, pro se, appellant.

Robert A. Butterworth, Attorney General, Tallahassee, for appellee.

We dismiss this appeal for failure to timely file the notice of appeal, but in light of appellant's claim that he did not timely receive a copy of the order denying his motion for rehearing, we do so without prejudice to the filing of a petition for belated appeal in accordance with Florida Rule of Appellate Procedure 9.140(j).

WEBSTER, DAVIS and VAN NORTWICK, JJ., concur.
