Opinion

Civil Action 2:00-CV-1048

April 29, 2002

ORDER

A discovery conference was held, by telephone, on April 29, 2002. All parties were represented.

Plaintiff's motion to file a surreply is GRANTED. The Clerk shall file the tendered surreply. Defendants may have until May 20, 2002 to file a surrebuttal, following which the motions to dismiss or to transfer will be at issue.

Much of the discovery process has been stayed pending resolution of the motions to dismiss or to transfer. The defendants take the position that discovery would be inefficient pending resolution of those motions.

Another discovery conference will be held on June 20, 2002 at 10:00 a.m. Prior to that time, plaintiff will have propounded a formal document request and defendants will have considered to what extent (1) they can produce the requested documents, (2) they can produce a privilege log, or (3) response to the request should be stayed pending resolution of the pending motions to dismiss or to transfer.
