ORDER MODIFYING OPINION AND DENYING REHEARING [NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered the opinion filed herein on March 29, 2007, be modified as follows:

On page 25, line 23, the second word "plaintiff" is changed to "defendant" so the sentence reads:

Plaintiff did not receive any form of notice from defendant until it received defendants January 21, 1998 letter requesting plaintiff to reinstate the Retz lease.

There is no change in the judgment. Defendants petition for rehearing is denied.
