JAMES MUSGROVE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 23rd District Court Brazoria County, Texas
Trial Court Cause No. 68992

ORDER

A portion of the reporter's record in this case was filed November 20, 2015. On May 2, 2017, the court reporter filed supplemental reporter's records of three pretrial hearings, which occurred on January 5, 2015, January 22, 2015, and May 27, 2015. Appellant has identified another date on which a pretrial hearing was held, March 16, 2015.

On May 16, 2017, we ordered Becky Serrato, the official court reporter, to file the record of the pretrial hearing held March 16, 2015. On that same day, we received notice from Sarah Caldwell that she reported the hearing held March 16, 2015, not Becky Serrato. Ms. Caldwell also notified this court that the record would not be prepared until appellant paid for the record. Appellant is indigent, was appointed counsel on appeal, and is entitled to a free reporter's record. Therefore, we withdraw our May 16, 2017 order, and order Sarah Caldwell to file the record of the pretrial hearing held March 16, 2015 in this appeal within 20 days of the date of this order.
