Action to recover damages for personal injuries sustained by the named plaintiff as a result of the defendant's alleged negligence, brought to the Superior Court in the judicial district of New Haven and referred to Hon. Frank S. Meadow, state trial referee; judgment for the named plaintiff on the first count of the complaint, and for the defendant on the second count of the complaint; thereafter, the court granted the defendant's motion to open and modify the judgment, and rendered a modified judgment for the named plaintiff, from which the defendant appealed to this court. Affirmed.
