Morrow v. Morrow

Supreme Court of Louisiana
Aug 18, 1998
719 So. 2d 492 (La. 1998)

Opinion

No. 98-C-2144.

August 18, 1998.

Prior report: 713 So.2d 721.

In re Morrow, Robert Edward, Sr.; — Plaintiff(s); applying for writ of certiorari and/or review; to the Court of Appeal, Third Circuit, No. CA98-0017; Parish of Natchitoches, 10th Judicial District Court, Div. "B", No. 66,513-B.

Denied. Stay request moot.

JOHNSON, J., not on panel.

LEMMON, J., concurs, but notes the un-fortunate circumstance of a second change in the custodial parent after a first change granted by the trial court over a year ago. Such disruption of the child's surroundings could be avoided if the courts of appeal would adopt a procedural rule requiring expedited disposition of appeals in custody cases, particularly when the appeal involves a trial court judgment changing custody.
