We affirm on the authority of Hemingway v. State, No. 4D98-3673 (Fla. 4th DCA May 24, 2000) and United States v. Guapi, 144 F.3d 1393, 1395 (11th Cir. 1998). The Guapi court observed that the United States Supreme Court "has specifically rejected the notion that police officers must always inform citizens of their right to refuse when seeking permission to conduct a warrantless consent search." Id. (citation omitted).

We note that the Fourth Amendment analysis emanating from Florida v. Bostick, 501 U.S. 429 (1991), has come under much criticism from commentators. See Tracey Maclin, Justice Thurgood Marshall: Taking the Fourth Amendment Seriously, 77 Cornell L. Rev. 723,801-02 (1992) (footnotes omitted). We recognize that this is not the appropriate court to reexamineBostick. See Art. I, § 12, Fla. Const.
