Present — Johnston, Acting P.J., Adel, Wenzel, MacCrate and Schmidt, JJ.

Defendant Paul Baron appeals from a judgment in favor of the plaintiff in an action to recover damages for injuries alleged to have been sustained by reason of a defective step at the doorway of a store rented by appellant to a tenant in a building which plaintiff alleged was a multiple dwelling. Judgment unanimously affirmed, with costs. It was for the jury to say whether the premises were designed or intended to be occupied by three families and whether the step was defective and appellant had notice thereof.
