Mishler v. Zakheim

District Court of Appeal of Florida, Third District
Oct 29, 1993
625 So. 2d 81 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-2499.

September 28, 1993. Rehearing Denied October 29, 1993.

An Appeal from the Circuit Court for Dade County; Philip Bloom, Judge.

Ward Caggiano, Karen J. Haas, Miami, for appellants.

Burt E. Redlus, James C. Blecke, Blackwell Walker and James E. Tribble, Miami, George V. Lanza, Coral Gables, Magill Lewis and Fred Lewis, Miami, for appellees.

Before SCHWARTZ, C.J., and HUBBART and NESBITT, JJ.

Because we find clear error in the trial court's exclusion of the testimony of the plaintiffs' proposed expert witnesses under section 766.102, Florida Statutes (1991), the summary judgment entered below on that basis is reversed and the cause is remanded for trial as to all defendants.
