Judgment and order affirmed, with costs. All concurred, except Hiscock, J., who dissented upon the ground that it was error to refuse to charge as requested by defendant's counsel, that in addition to the other elements referred to in the charge, plaintiff "must show that the dog was improperly confined, that he was let loose negligently."
