Menes v. Fla. Parole Prob. Com'n

District Court of Appeal of Florida, First District
Nov 24, 1982
422 So. 2d 1015 (Fla. Dist. Ct. App. 1982)

Opinion

No. AM-182.

November 24, 1982.

Appeal from the Parole and Probation Commission.

William L. Menes, pro se, appellant.

Earl H. Archer, Asst. Gen. Counsel, Florida Parole and Probation Com'n, Tallahassee, for appellee.

Appellant contends that the Parole and Probation Commission erred in assigning his presumptive parole release date (PPRD). We disagree and affirm.

Aggravation for multiple offenses with concurrent sentences is proper. Sala v. Florida Parole and Probation Commission, 414 So.2d 263 (Fla. 1st DCA 1982). Commission of an offense while on bond may be used to aggravate a PPRD. Fla. Admin. Code Rule 23-21.10(4)(a)(2)(a).

SHAW and WIGGINTON, JJ., concur.
