Appellant has moved to expedite this appeal. Appellee concurs stating that it was error for the lower tribunal to dismiss the petition under the particular facts. We elect to treat appellee's response as a confession of error. The final order is reversed and remanded for further proceedings.

REVERSED AND REMANDED.
