SUBSTITUTE MEMORANDUM OPINION

We withdraw our opinion issued April 4, 2017, and substitute this opinion in its place. This is an appeal from a judgment signed July 15, 2016. On March 21, 2017, appellant filed a motion to dismiss the appeal. See Tex. R. App. P. 42.1. On April 4, 2017, this court granted appellant's motion and dismissed the appeal.

On May 4, 2017, appellant filed a motion seeking clarification that the appeal was dismissed with prejudice to refiling. The motion is granted.

Accordingly, the appeal is ordered dismissed with prejudice.
