APPEAL, by permission of the Appellate Division of the Supreme Court in the Fourth Judicial Department, from an order of the Supreme Court, Monroe County (Francis A. Affronti, J.), entered January 19, 2006 in a proceeding pursuant to CPL 330.20 (16). The order, among other things, denied respondent's motion for judgment notwithstanding the verdict or, alternatively, to set aside the verdict and for a new hearing.
