Matter of Richmond v. Mass and Bizrt

Appellate Division of the Supreme Court of New York, Third Department
May 11, 1949
275 App. Div. 879 (N.Y. App. Div. 1949)

Opinion

May 11, 1949.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Bergan, JJ.

Appeal by employer and carrier from a decision and award for disability. The board has found that claimant's present condition, diagnosed as phlebitis migrans, resulted from the bite of an insect which was an accidental injury arising out of and in the course of the employment. Although the medical evidence as to causal relationship is conflicting we may not say there is no substantial evidence to sustain the finding. Decision and award unanimously affirmed, with costs to the Workmen's Compensation Board.
