Matter of McCoy v. George H. Flinn Corp.

Appellate Division of the Supreme Court of New York, Third Department
Jan 17, 1962
15 A.D.2d 704 (N.Y. App. Div. 1962)

Opinion

January 17, 1962

The employer and carrier appeal from a decision and award which granted a schedule award in addition to another award for total permanent disability, both arising from the same employment and covering a concurrent period. There is no substantial difference between this case and Matter of Wilkosz v. Symington Gould Corp. ( 14 A.D.2d 408), which had not been decided when the board made the decision in this case. The Wilkosz case must be controlling here. Award reversed, with costs to appellants. Coon, J.P., Gibson, Herlihy, Reynolds and Taylor, JJ., concur.
