Matter of Marco v. Municipal Civil Service Comm

Appellate Division of the Supreme Court of New York, First Department
Jan 15, 1952
279 App. Div. 773 (N.Y. App. Div. 1952)

Opinion

January 15, 1952.

Present — Peck, P.J., Glennon, Callahan, Van Voorhis and Shientag, JJ.; Shientag, J., dissents and votes to affirm. Settle order on notice.

Order reversed, with $20 costs and disbursements to the appellants, and the petition dismissed. In view of the wording of the "Medical Regulations" with respect to re-examination, we think it was improper for the court to direct a second re-examination of the petitioner.
