Matter of Justin L

Appellate Division of the Supreme Court of New York, Fourth Department
Feb 10, 1999
258 A.D.2d 934 (N.Y. App. Div. 1999)

Opinion

February 10, 1999

Appeal from Order of Jefferson County Family Court, Hunt, J. — Abuse.

Present — Denman, P. J., Pine, Hayes, Wisner and Callahan, JJ.

Appeal unanimously dismissed without costs. Memorandum: The order sought to be appealed recites that it was based on the consent of respondent. The record establishes that respondent consented to both the findings of abuse and neglect, without an admission of guilt, and also agreed to the proposed disposition. No appeal lies from the order because respondent is not an aggrieved party ( see, CPLR 5511; Matter of Christa A., 256 A.D.2d 1093; Matter of Poler v. Larimer, 204 A.D.2d 1067).
