Matter of Jacoby v. McNamara

Appellate Division of the Supreme Court of New York, First Department
Mar 14, 1949
275 App. Div. 695 (N.Y. App. Div. 1949)

Opinion

March 14, 1949.

Present — Peck, P.J., Glennon, Callahan, Van Voorhis and Shientag, JJ.;

Order affirmed, with $20 costs and disbursements to the petitioners-respondents. No opinion.

Shientag, J., concurs in the result solely on the ground that, while there was no violation of its rules, the action of the commission in changing the announced method of rating and grading the papers in the examination in question was, under the circumstances, wholly unwarranted.
