Court of Appeals of the State of New York
Apr 18, 1967
19 N.Y.2d 836 (N.Y. 1967)

Opinion

Submitted April 3, 1967

Decided April 18, 1967

Appeal from the Appellate Division of the Supreme Court in the First Judicial Department, BIRDIE AMSTERDAM, J.

Nathan L. Levine for motion.

Patrick J. Hughes opposed.

Motion granted and appeal dismissed, with costs and $10 costs of motion, upon the ground that it is untimely (CPLR 5513, subd. [a]) and that CPLR 5514 (subd. [a]) does not apply where, as here, the subsequent appeal is from an order different from that to which the appeal previously dismissed was addressed.
