Matter of Gerald

Appellate Division of the Supreme Court of New York, Second Department
Feb 20, 1990
158 A.D.2d 599 (N.Y. App. Div. 1990)

Opinion

February 20, 1990

Appeal from the Family Court, Nassau County (Mosca, J.).

Ordered that the appeal is dismissed, without costs or disbursements.

No appeal lies from an order issued on consent (CPLR 5511; Bahr v Bahr, 105 A.D.2d 725). In any event, the period of placement has expired, rendering moot the appeal from the order directing it (see, Matter of Anonymous [Boggs] v New York City Health Hosps. Corp., 70 N.Y.2d 972; cf., People v Skaar, 97 A.D.2d 484). Mangano, J.P., Bracken, Eiber and Harwood, JJ., concur.
