Opinion

March 25, 1952.

Present — Cohn, J.P., Callahan, Van Voorhis, Shientag and Foster, JJ.

Order unanimously modified so as to fix land values for the years indicated as follows:

1948-49 1949-50 1950-51

Lot 33 $1,400,000 $1,460,000 Lot 37 356,000 Lot 38 340,000 $340,000 Lot 39 433,000 433,000. As so modified the order is affirmed, with $20 costs and disbursements to defendants. The land valuation on Lot 33 for 1949-50 is higher than that fixed by the assessors, but the total assessment is no higher and the court reviews the total amount of the assessment. Settle order on notice.
