Appeal, No. 268, Jan. T., 1937, from judgment of Superior Court, Oct. T., 1936, No. 445, affirming the judgment of M. C. Phila. Co., Feb. T., 1935, No. 328, in case of Bernard N. Levene v. Thomas S. Lanard. Judgment affirmed.

Assumpsit. Before WALSH, J., without a jury.

The facts are stated in the opinion of the Superior Court, reported in 126 Pa. Super. 573.

Verdict and judgment for plaintiff. Defendant appealed to the Superior Court, which affirmed the judgment of the court below. Appeal by defendant allowed to Supreme Court.

Errors assigned were conclusion of law of Superior Court, refusal to sustain various assignments of error, and the entry of judgment.

We are not convinced that the Superior Court erred in affirming the judgment of the Municipal Court.
