ORDER

Kathleen Kerrigan Chief Judge

On October 2, 2023, the parties jointly filed a Motion to Calendar. stating that the parties have been unable to reach a settlement in this case and requesting that this case be calendared for a special two-day trial session in late June 2024. We will treat the parties' motion as a Motion for Assignment of Judge. Furthermore, as it appears this case can be heard during a regularly scheduled trial session and the motion does not otherwise establish a need at this juncture for an assignment of Judge, we will deny the parties' motion without prejudice.

Upon due consideration of the foregoing, it is

ORDERED that the parties' joint Motion to Calendar is recharacterized as a Motion for Assignment of Judge. It is further

ORDERED that the Motion for Assignment of Judge is denied without prejudice.
