In an action by a contractor to foreclose its mechanic's lien on certain real property owned by defendant Herman Homes, Inc., other contractors, namely, Benny S. Ragonesi and Thomas Ragonesi, who filed their mechanic's lien after the commencement of this action, appeal from an order of the Supreme Court, Queens County, dated April 28, 1961, which denied their motion to intervene in the action as party defendants, nunc pro tunc, as of November 1, 1960. Such motion was made after the action had been tried, after the entry of a judgment of foreclosure, and after the sale of the property pursuant to such judgment. Order affirmed, with $10 costs and disbursements. No opinion. Beldock, Acting P.J., Kleinfeld, Christ, Pette and Brennan, JJ., concur.
