On Appeal from the 185th District Court Harris County, Texas
Trial Court Cause No. 679887
MEMORANDUM OPINION
Appellant Lextor Kennon Kossie attempts to appeal the denial of a motion for judgment nunc pro tunc. This court affirmed appellant's conviction for aggravated robbery. See Kossie v. State, No. 14-94-01171-CR; 1997 WL 109996, at *3 (Tex. App.—Houston [14th Dist.] Mar. 13, 1997, no pet.) (not designated for publication). Appellant subsequently filed a motion for judgment nunc pro tunc, which the trial court denied.
We do not have appellate jurisdiction of the denial of a motion for judgment nunc pro tunc. Desilets v. State, 495 S.W.3d 553, 554 (Tex. App.—Beaumont 2016, pet. ref'd). The appropriate remedy to obtain review of the denial of a nunc pro tunc motion is by a petition for writ of mandamus. See Ex parte Molina, 483 S.W.3d 24, 25-26 (Tex. Crim. App. 2016).
Accordingly, we dismiss the appeal for lack of jurisdiction.
PER CURIAM Panel consists of Chief Justice Frost and Justices Christopher and Jamison.
