In an action by a husband against his wife for a judgment declaring that he is the sole owner of a one-family house, title to which is held by them as tenants by the entirety, the plaintiff appeals from a judgment of the Supreme Court, Nassau County, dated July 16, 1958, entered upon the decision of the court, dismissing the complaint upon the merits, after a nonjury trial. Judgment affirmed, with costs (cf. Williams v. Williams, 4 A.D.2d 793, affd. 5 N.Y.2d 895; Torrella v. Torrella, 5 A.D.2d 775). Nolan, P.J., Beldock, Ughetta, Kleinfeld and Brennan, JJ., concur.
