On September 3, 2024, the parties filed a Joint Status Report stating, among other things, that a conference took place on October 19, 2023, between petitioner and the Independent Office of Appeals and that the case has not yet been resolved. Respondent anticipates filing a motion to consolidate this case with Thompson Timberlands, LLC, Mitigation Resources Group, LLC Tax Matters Partner v. Commissioner, Dkt. No. 28455-21 and is awaiting a response from petitioner as to whether they object to a consolidation. If the cases are consolidated, the parties will likely request a special trial session in the fall of 2025. The parties are also discussing a potential stipulation to be bound in lieu of a consolidated special trial session. The parties request additional time to attempt to resolve the issues in this case and/or for trial preparation and request the Court to order an additional joint status report in 180 days. ORDERED that on or before March 3, 2025, the parties shall file a joint status report regarding the then-current status of this case.
