ORDER TO SHOW CAUSE
Christian N. Weiler, Judge.
This case was scheduled for trial at the Trial Session of this Court on March 27, 2023, at Los Angeles, California. Respondent filed an unopposed motion for continuance, which the Court granted. This case was stricken from the March 27, 2023 trial session, and the parties were ordered to file a status report or proposed stipulated decision by May 26, 2023. On April 18, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution; in the motion, respondent's counsel indicates how she has not been able to communicate with petitioner nor with his representative, Ms. Rachelle Knapp, since filing the motion for continuance.
Considering the foregoing, it is
ORDERED that, no later than May 30, 2023, petitioner, or petitioner's representative shall file a response to respondent's motion to dismiss showing cause why the motion should not be granted. The response should correct any factual errors in respondent's motion and, more important, should describe petitioner's current efforts to resolve this matter. (Or, if petitioner decides to concede this case, then his response should so state, and he should cooperate with respondent in filing a stipulated decision reflecting that concession.) It is further
ORDERED that a copy of this Order to Show Cause shall be served on petitioner's representative by the clerk's office at the following address: Rachelle Knapp 769 Lavender Lane Templeton, CA 93465.
Petitioner is advised that failure to respond to this Order to Show Cause could result in the dismissal of the case and entry of decision for respondent as requested in his motion.
