Plaintiff Kids of America Corp., has filed a motion to amend its complaint. In a letter dated May 14, 2004, plaintiff has advised the court that its motion to amend is to be considered only if the court grants defendant's pending motion to dismiss. Accordingly, I will not act on the motion to amend at this time.
