Appeal, No. 112, Jan. T., 1943, from judgment of Superior Court, Feb. T., 1943, No. 33, affirming judgment of C. P. Luzerne Co., May T., 1939, No. 935, in case of George Kazan v. Wilkes-Barre Railway Corporation. Judgment affirmed.

Trespass for personal injuries and property damage. Before FARRELL, J.

The facts are stated in the opinion of the Superior Court, reported in 151 Pa. Super. 38.

Verdict for plaintiff in sum of $1,374, reduced to $674, and judgment thereon. Defendant appealed to Superior Court which affirmed the judgment of the court below. Appeal by defendant to Supreme Court allowed.

The judgment entered by the Superior Court is affirmed on the opinion of Judge BALDRIGE of that court.
