Present — Carswell, Acting P.J., Johnston, Sneed, Wenzel and MacCrate, JJ.


Action on an insurance policy to recover a loss due to burglary. Order granting defendant's motion to dismiss the complaint, on the ground that the action is barred because of the failure of plaintiff to commence the action within twelve months after the happening of the physical loss, and the judgment entered thereon, unanimously affirmed, with costs. No opinion.
