Opinion

CIVIL ACTION NO. 3:95-CV-0590-G

May 21, 2001

ORDER

The court is in receipt of a letter from the plaintiff, filed May 18, 2001, which it construes as a motion to vacate the order of April 9, 1998 regarding payment of an appellate filing fee. This relief has already been considered and denied, not once but twice. For the first time, see motion filed December 12, 2000; order of reference filed January 19, 2001; findings, conclusions, and recommendations of magistrate judge filed January 22, 2001; and order adopting the findings and recommendations filed February 9, 2001. For the second time, see motion filed March 23, 2001 and order filed March 28, 2001.

This motion is now DENIED for the third time. Because of the repetitious and frivolous nature of these motions, the clerk is directed to accept no further filings from the plaintiff without leave from a judge of this court.

SO ORDERED
