ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT

COOPER, P. J. RUBIN, J. FLIER, J.

It is ordered that the opinion filed on April 23, 2008, be modified as follows:

(1) On page 6, the last sentence in the second paragraph is deleted. The following sentence is inserted in its place: “Finally, the court refused to take judicial notice of an unpublished opinion as requested by Blonde.”

(2) On page 12, the first sentence in the second paragraph is deleted. The following sentence is inserted in its place: “We need not consider Jewell’s argument that the court improperly relied on an unpublished case disparaging of counsel because the court stated in its order that it declined to take judicial notice of the unpublished opinion.”

There is no change in judgment.

Appellant’s petition for rehearing is denied.
