MEMORANDUM OF DECISION RE AMENDED MOTION TO DISMISS DATED JANUARY 25, 2006


The motion to discharge from the hearing in damages list dated November 6, 2002 was also a motion to dismiss the P.J.R. There was no signed complaint before the court and no effort has been made to provide one. The court granted both parts of the motion. The motion dated January 25, 2006 is a motion to dismiss the case in its entirety. It is herewith granted since there is actually no case before the court.
