Opinion

Civil Action 4:23-cv-198

10-11-2023

STEPHEN JEFFERY JENKINS, JR., Plaintiff, v. PORT WENTWORTH POLICE DEPARTMENT, et al., Defendants.

ORDER

R. STAN BAKER, UNITED STATES DISTRICT JUDGE.

After a careful de novo review of the entire record, the Court concurs with the Magistrate Judge's September 8, 2023, Report and Recommendation, (doc. 9), to which plaintiff has not filed an objection. The Court ADOPTS the Report and Recommendation as its opinion. Plaintiff's Complaint is DISMISSED. The Magistrate Judge's previous Report and Recommendation, recommending dismissal of some parties, is DISMISSED as moot. (Doc. 6.) The Clerk of Court is DIRECTED to CLOSE this case.

In fact, the service copy of the Report and Recommendation was returned as undeliverable. (Doc. 10.) Jenkins, therefore, appears to have failed to comply with the Local Rules' requirement “to apprise the Court of any address change.” L.R. 11.1. Jenkins' noncompliance with Local Rule 11.1 provides an alternative basis for dismissal. Cf. Fed.R.Civ.P. 41(b).

SO ORDERED.
